The rules, in plain words.
These terms apply to every website design and care service sold by DESN. These services are for professionals only (businesses, tradespeople, shops, freelancers, associations) ordering a website for their activity. The signed quote always details what is done for you and prevails over this page if they differ. The French version of these terms is the one that legally applies.
1. Who sells
Quentin Desnouveaux, sole trader in France trading as DESN, Ruelle du Pavillon, 77170 Coubert, France. SIRET 109 598 938 00016. Email: pro.desnouveaux@gmail.com.
2. Services
- Website only: design and launch of a showcase website, paid once. Hosting, domain name and changes after launch are the client's responsibility.
- Website + care: design and launch of the website, then a monthly subscription covering the domain name, hosting, updates, backups, 2 changes a month and your visitor figures every 3 months. The domain name is registered in the client's name, as its owner (registrant); DESN books, pays for and manages it on their behalf. A standard domain name (.fr, .com…) is included up to €20 a year; if the chosen name costs more (premium name or special extension), the difference is charged to the client, with their prior agreement.
- Options (extra pages, booking calendar, multilingual website, online quotes, Google profile…): on quote.
DESN does not build online shops. No ranking in Google results is guaranteed.
3. Quote and order
Every project gets a free written quote, valid for 30 days. The order is final when the client returns the signed quote or accepts it in writing (email included), together with the deposit set out in section 5.
4. Prices
Prices are in euros, net: VAT not applicable, article 293 B of the French tax code. The launch price of the Website + care plan is reserved for the first 5 clients. The price that applies is the one in the accepted quote.
5. Payment
- Website design: 30% deposit when the quote is signed, balance at launch.
- Website + care subscription: €39 a month, payable monthly by direct debit, starting the month of launch.
- Any late payment incurs penalties equal to three times the French legal interest rate and a fixed €40 recovery fee (articles L441-10 and D441-5 of the French commercial code). No discount for early payment.
- If a payment is more than 30 days late and a formal notice has gone unanswered, DESN may suspend the care service (changes, reports) until full payment.
6. Process and timing
The client provides the information needed (business, opening hours, photos if any). DESN writes the copy, shows a mockup, then the website. Nothing goes live without the client's approval. The indicative timeframe is two to four weeks, and also depends on how quickly the client replies. The quote includes 2 rounds of changes on the mockup; further rounds are quoted separately.
7. Website + care: term and cancellation
The subscription runs for 12 months from launch. If the client stops it before the end of those 12 months, the remaining monthly payments up to month 12 are due in a single payment (for example, stopping after 8 months: 4 × €39 = €156). After that it continues month to month with no commitment and can be stopped at any time, with one month's notice, by email. Unused monthly changes do not roll over. A change means a small content update (text, photo, opening hours, price); a new page or feature is quoted separately.
When the subscription ends, the client keeps their website: DESN hands over the files and helps them take over the management of their domain name, which is already in their name.
8. Ownership
Once the design price is paid in full, the client owns the website made for them (copy, design, code). Open-licence fonts and tools remain under their licence. The client guarantees they have the right to use the text, logos and photos they provide. Unless the client refuses in writing, DESN may show the website in its portfolio.
9. Liability
DESN does its best to deliver a working website and keep it online, but cannot guarantee full availability, which also depends on the host. DESN is not responsible for content provided by the client.
10. Right of withdrawal
If the contract is signed away from DESN's premises (for example at a meeting at the client's place) with a business of 5 employees or fewer whose main activity is not website design, that client has 14 days after signing to withdraw, without giving a reason, by email. If they ask for work to start before that period ends, they pay for the work already done if they withdraw.
11. Personal data
For the forms on the client's website (contact, booking), DESN acts as a processor within the meaning of Article 28 of the GDPR. DESN processes this data only to run the website, on the client's instructions, with appropriate security measures, and keeps it confidential. The data passes through the website host and the form delivery service chosen by DESN (currently Cloudflare and Web3Forms). DESN informs the client without delay of any data breach. At the end of the contract, DESN deletes or returns to the client the data it holds.
12. Disputes
These terms are governed by French law. In case of disagreement, both parties first look for an amicable solution. Otherwise, the dispute goes to the competent court where DESN is based.
